1. Introduction
Welcome to Brand Crest Media, a newspaper advertisement booking platform operated by Vivacious Solutions. These Terms & Conditions govern your use of our website, booking flow, customer dashboard, payment process, support services and related features.
By accessing Brand Crest Media, creating an account, submitting an advertisement, uploading artwork/documents, making payment or using any service on the website, you agree to follow these Terms & Conditions.
If you do not agree with these terms, please do not use our website or services.
2. Advertisement Booking Service
Brand Crest Media helps users book newspaper advertisements through an online process. We may collect ad content, artwork, documents, publication preferences, city, edition, category, package, payment and contact details to process your booking.
Brand Crest Media acts as a booking/support platform and may process advertisements on behalf of newspaper publications, publication partners or related service providers.
Final acceptance, rejection, publication date, position, category placement, edition availability and ad release may depend on the concerned newspaper/publication policies.
3. User Responsibility
The user/advertiser is responsible for ensuring that all information, advertisement matter, images, logos, claims, documents and instructions submitted are true, accurate, lawful and complete.
The advertiser confirms that nothing material has been concealed and the advertisement content complies with applicable laws, publication guidelines and category requirements.
Brand Crest Media is not responsible for consequences arising due to false, misleading, incomplete, unauthorized or unlawful content submitted by the advertiser.
4. Content of Advertisement
All advertisement content submitted by the user is accepted in good faith.
Brand Crest Media may request corrections, additional documents or clarification if the advertisement appears incomplete, unclear, legally sensitive, category-specific or publisher-dependent.
The advertiser agrees to indemnify Brand Crest Media, Vivacious Solutions, newspaper publications and related partners against any legal, civil, financial or third-party claim arising from the advertisement content submitted by the advertiser.
Brand Crest Media reserves the right to edit, reject, hold, cancel or request modification of any advertisement if required for publication policy, legal compliance, technical standards or internal review.
5. Prohibited Content
Users must not submit any advertisement, text, image, document or message that is illegal, misleading, defamatory, obscene, hateful, offensive, threatening, discriminatory or violates any law.
Advertisements involving counterfeit goods, stolen goods, controlled substances, dangerous products, unlawful services, fake claims, unauthorized use of trademark/copyright material or content that may hurt public sentiment may be rejected.
Brand Crest Media reserves the right to refuse service, remove submitted content, cancel bookings or report suspicious activity where required.
6. Category & Subcategory Selection
Users must select the correct newspaper, city, edition, category, subcategory, package and advertisement type while booking.
If the selected category/subcategory is incorrect, unavailable or not accepted by the publication, the advertisement may be shifted, held, corrected or placed as per publisher/editorial discretion.
Any changes in category, edition, size, package or format may affect pricing, publication availability and approval status.
7. Artwork, Documents & Approval
Where required, users must upload valid artwork, identity proof, authorization letters, business documents, certificates or any other required material within the required time.
If required documents or corrections are not provided on time, the advertisement may be delayed, rejected or cancelled, and the user will be responsible for such delay or cancellation.
Artwork quality, size, format, font visibility, image clarity and content compliance remain the responsibility of the advertiser unless specifically corrected by our support team.
8. Payment Terms
Advertisement booking may require advance payment through available online payment methods or any other approved payment mode.
Payment confirmation does not guarantee publication until the advertisement is reviewed, accepted and processed as per publication policy.
Users are responsible for all applicable taxes, charges, gateway fees, publication charges, correction charges, additional size charges or other costs related to the booking.
If pricing changes due to incorrect category, city, edition, size, artwork, document requirement or publisher revision, the user may be required to pay the difference before processing.
9. Cancellation, Changes & Refunds
Cancellation, correction, alteration, rescheduling or stop-order requests must be submitted in writing through the website, email or approved support channel.
Requests will be accepted only if the advertisement has not already been processed, sent for release, approved by the publication or moved to a non-editable publication stage.
Once the ad status reaches a stage where the publication process has started, changes or cancellation may not be possible.
Refunds, if applicable, will be processed according to the cancellation/refund policy and may be subject to deduction of processing, gateway, service or publisher charges.
If an advertisement is missed due to a publication-side issue and the publication confirms the same, refund or rescheduling may be handled as per publisher approval and internal policy.
10. Rescheduling & Publication Date
Brand Crest Media and/or the publication may reschedule an advertisement due to space availability, edition issue, technical error, document delay, late approval, payment delay or publication policy.
For multi-city, multi-edition or multi-publication bookings, publication dates may vary depending on availability and processing requirements.
Brand Crest Media will try to support users with updates, but final release date and publication acceptance may depend on the newspaper/publication.
11. Listing Placement / Position
Unless specifically confirmed in writing by the publication, no fixed page, position, placement, section, side, column or premium spot is guaranteed.
Publication placement may depend on editorial policy, availability, category, page planning and newspaper discretion.
Brand Crest Media is not liable if the advertisement is published in a different position/category/section due to publisher discretion, unless a confirmed paid placement commitment exists.
12. Limitation of Liability
Brand Crest Media is not liable for any loss, delay, missed opportunity, business loss, reputation loss or indirect damages arising from advertisement rejection, delay, rescheduling, printing error, publication-side omission or user-submitted incorrect information.
Brand Crest Media is not responsible for any action taken by users based on advertisements, responses, calls, messages or third-party interactions generated from published ads.
The service is provided on an as-is and as-available basis. We do not guarantee uninterrupted, error-free or always-available service.
13. Dealings With Third Parties
Any response, communication, transaction, negotiation or dealing between users and third parties arising from published advertisements is solely between those parties.
Brand Crest Media does not verify every respondent, buyer, seller, advertiser or third party interacting through an advertisement.
Users should independently verify all claims, offers, contacts and transactions before taking any action.
14. Communication Consent
By using Brand Crest Media, you consent to receive communication from us through email, phone calls, SMS, WhatsApp or other available support channels for booking, payment, document, correction, publication and service updates.
We may also send important notices, policy updates, booking reminders, support messages and service-related communication.
Promotional communication may be sent where permitted, and users may request to opt out where applicable.
15. User Account & Data
Users are responsible for keeping their login credentials confidential and for all activities performed through their account.
Users must ensure that all account details, booking information, billing information and uploaded data are accurate and updated.
Brand Crest Media may retain booking records, invoices, uploaded documents, communication and transaction references for support, legal, audit, tax, publisher and operational purposes.
16. Refusal of Service
Brand Crest Media reserves the right to refuse service, cancel bookings, remove content, suspend accounts or restrict access if any user violates these Terms & Conditions, submits prohibited content, misuses the platform or creates legal/business risk.
We may cooperate with legal authorities, publication partners, payment gateways or investigation agencies where required by law or necessary to prevent misuse.
17. Schemes, Offers & Discounts
Any offers, discounts, promotional packages, schemes or special pricing may be time-limited and subject to specific conditions.
Offers cannot be clubbed with other offers unless clearly mentioned.
Brand Crest Media may modify, withdraw or discontinue any offer, discount, package or service without prior notice.
18. Visual Confirmation of Advertisement
Users may verify published advertisements through the concerned newspaper copy, e-paper edition or any confirmation shared by the publication where available.
Brand Crest Media may not always be able to provide scanned copies or physical newspaper copies unless such service is specifically offered and confirmed.
If a user is not a subscriber of the newspaper, they may verify through e-paper availability, family/friends, or publication confirmation wherever possible.
19. Governing Law
These Terms & Conditions shall be governed by the laws of India.
Any dispute shall be subject to the jurisdiction of the competent courts applicable to Vivacious Solutions / Brand Crest Media business location, unless otherwise required by law.
20. Changes to Terms
Brand Crest Media may update, modify or replace these Terms & Conditions at any time to reflect changes in business process, publication rules, payment process, legal requirements or service features.
Updated terms will be posted on this page with a revised update date.
Continued use of Brand Crest Media after changes means you accept the updated Terms & Conditions.
